Compliance and enforcement of work health and safety (WHS) legislation in NSW is the role of WorkCover NSW and the Department of Trade and Investment (for mines and coal workplaces).
The functions and powers of WorkCover include:
- providing advice and information on work health and safety to duty holders and the community
- fostering a cooperative, consultative relationship between duty holders and those to whom they owe duties and their representatives
- engaging in, promoting and coordinating the sharing of information to achieve the objectives of the WHS legislation
- targeted programs eg 10/5/5 program
- promoting and supporting education and training
- reporting on the operation and effectiveness of the WHS legislation
- collecting, analysing and publishing statistics
- administering internal reviews
- developing tools to assist with compliance
- monitoring and enforcing compliance with the WHS legislation through notices, enforceable undertakings, legal proceedings and prosecutions.
