The NSW Government, in conjunction with the other Commonwealth and State/Territory jurisdictions, is committed to reducing the burden of regulation on the community and economy. To this end, the NSW Government introduced the requirement for a Better Regulation Statement, which supports and enhances better regulation making principles contained in the Subordinate Legislation Act 1989.
Better Regulation Statements (BRS)
The Premier’s Memorandum 2009-20 Guide to Better Regulation mandates that significant new and amending proposals must be supported by a Better Regulation Statement.
A Better Regulation Statement is a succinct document, which justifies a regulatory proposal. It demonstrates that the better regulation principles have been applied when developing the regulatory proposal and that the benefits of the proposal outweigh the costs.
The Better Regulation Office in the Department of Premier and Cabinet supports the Minister for Regulatory Reform. The office acts as a gatekeeper, conducts targeted reviews, monitors and reports on compliance with better regulation requirements, and provides ongoing advice to assist agencies to meet the better regulation requirements.
Regulatory Impact Statements (RIS)
Regulatory Impact Statements (RIS), prescribed by the Subordinate Legislation Act 1989, are normally required when a principal regulation is made, or when a regulation is to be remade under the staged repeal program. They are an effective means of raising public involvement in the regulation-making process, as they provide members of the community with the opportunity to comment on regulations, before they become law.
The primary purpose of regulatory impact statements is to ensure that the economic and social costs and benefits of regulatory proposals are examined fully so that ministers proposing the regulations and members of the community can be satisfied that the benefits of the regulations exceed the costs.
