Penalties for fraud 

The following include the most common offences investigated and prosecuted by WorkCover NSW:

  • providing false or misleading information relating to claims – fines up to $55,000 and/or two years imprisonment
  • failing to pass on the correct workers compensation benefits to workers – fines up to $5500)
  • failing to inform the insurer of additional employment and/or income while on injured worker benefits – fines up to $4400
  • making a false or misleading statement in a notice of injury – fines up to $11,000
  • obtain money by deception – liable to imprisonment for 5 years
  • obtain money by false or misleading statement – liable to imprisonment for 5 years.

Did you know...

If an employee is convicted of committing fraud against the Workers Compensation System an employer may be entitled to a retrospective amendment of their workers compensation premiums.
