Can a worker apply for a private ruling?

No. Private rulings decide whether a person is a worker or contractor for premium purposes only. As such employers or their delegated officers only are able to lodge a private ruling application.

 

How does a private ruling affect me?

A private ruling decision is the result of a request by an employer to WorkCover to determine the status of their worker(s) for wage record and premium calculation purposes. A private ruling does not impact upon a person’s ability to lodge a workers compensation claim nor can it be used in any claims-related matters.

 

If I have an ABN am I an independent contractor?

Just because you have an ABN does not necessarily mean you are an independent contractor. Your full employment relationship should be considered when determining if you are a worker or contractor.

 

I work for a labour hire company, but work at various locations for various businesses, who is my employer?

The labour hire company pays your wage and is your employer, regardless of who or where you perform the work.
